YOU ACKNOWLEDGE THAT YOUR CONTINUED USE OF THE SERVICE AFTER PUBLICATION OR NOTICE ABOUT CHANGES TO THIS PRIVACY POLICY MEANS THAT THE COLLECTION, USE AND SHARING OF YOUR PERSONAL DATA IS SUBJECT TO THE UPDATED PRIVACY POLICY.

The Service to which this Privacy Policy applies is owned and operated by Health Intelligence Company, LLC d/b/a Blue Health Intelligence ("BHI"). BHI operates the Service on behalf of its partner organizations ("Partner(s)"). You are being granted access to the Service by, through or on behalf of a Partner.

INFORMATION COLLECTED

BHI collects any information that you provide in your account. Some information may be required to use and access the Service, while other information may be optional and provided by you voluntarily. Information collected may include personally identifiable information such as your name, date of birth, e-mail address, phone number, location and additional information gathered about You when registering, managing your account, accessing the Service, or contacting BHI.

BHI also collects information automatically. Information that is or may be automatically collected is your IP address, browser type, and access times. This information helps track use of the Service, facilitate the user experience on the Service, and assist with customer service. BHI uses cookies and similar technologies to track use of the Service as well as to enhance functionality of the Service. You can turn off cookies, but it will affect your experience while using the Service. You can control cookies through your browser settings and other tools.

BHI logs usage data when you visit or otherwise use the Service, such as when you click on content or perform a search.

The Service is dynamic, and BHI often introduces new features which may require the collection of new information. If BHI collects materially different personal data or materially changes how it uses use your data, BHI will notify you and may also modify this Privacy Policy.

HOW YOUR PERSONAL INFORMATION IS USED

Registration.

Your personal information is used to create an account to use the Service.

Account Management/Communications.

BHI may use your personal information to respond to your requests for information, generate password resets, or to communicate with you.

Security and Investigations.

BHI uses your data if we think it's necessary for security purposes or to investigate possible abuses or illegal activities or other violations of BHI's Terms of Service or this Privacy Policy.

Regulatory Compliance.

Given that your use of the service provides you with access to data regarding the health and identity of other individuals, BHI may use your personal information and account activity in regulatory compliance related matters, including but not limited to investigations or accounting requests regarding the access or disclosure of health and personal information of other people.

Aggregate Insights.

BHI uses your data to generate aggregated insights that do not identify you. For example, BHI may use your data to generate statistics about users of the Service, such as measuring various trends and usage of the Service.

Customer Support.

We use the data (which can include your communications) to investigate, respond to and resolve complaints and Service issues (e.g., bugs).

Service Development/Improvement.

BHI uses data to conduct research and development for the further development of its Services in order to provide you, and others, with a better experience.

Administration/Communications.

BHI will contact you through email, phone, notices posted on the Services portal or related apps, and other ways through the Services. BHI will send you messages about the availability of the Services, security, or other service-related issues, as well as messages about how to use the Services, network updates, Services maintenance, and account activity.

HOW YOUR INFORMATION IS SHARED

Service Providers.

BHI uses others to help it provide the Service (e.g., maintenance, investigations, analysis, or development). Such parties will have access to your information as reasonably necessary to perform tasks on BHI's behalf and are obligated not to disclose or use it for other purposes.

Partner Organizations.

BHI operates the Services for its partner organizations (e.g., health plans). Your access to and use of the Service comes through one or more of these BHI partners. Representatives of these partners can access your information and data, as well as manage your use of the Services.

Legal Disclosure.

BHI may disclose your personal information with or without your consent if BHI is required to do so by law or court order.

Investigation Disclosure.

BHI may be required to investigate access and disclosure of the health and personal information of others accessible to you through the Service. Such an investigation may require disclosure of your personal information and account activity.

Regulatory Compliance.

Regulations may mandate that any individual whose data you have access to through the Service has the right to request an accounting of disclosures of their data. Should BHI receive such a request, your personal information and account activity may be subject to disclosure to the individual making the request or their authorized representative(s). In such instance, your personal information and account activity may also be disclosed to the BHI partner organization (e.g., health plan) from which your access to the Service is provided.

Corporate Event.

In the event of a corporate event such as a sale, merger, consolidation, change in control, reorganization or liquidation, then BHI may, as part of that transaction, transfer, sell or assign to a third party any information collected by the Service and discussed in this Privacy Policy.

SECURITY OF YOUR PERSONAL INFORMATION

Security of internet transmissions cannot be assured. However, BHI internally uses industry standard practices to prevent the unauthorized access of the Service and its internal systems. BHI regularly performs internal reviews of all security measures as well as limiting access to personal information to those individuals who require access. BHI implements security safeguards designed to protect your data. BHI regularly monitors its systems for possible vulnerabilities and attacks. However, BHI cannot warrant the security of any information that you make available in the Service. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

RIGHTS TO YOUR PERSONAL INFORMATION

You can ask BHI to erase or delete all or some of your personal data (e.g., if it is no longer necessary to provide Services). You can edit some of your personal data through your account. You can also ask BHI to change, update or fix your data in certain cases, particularly if it's inaccurate. You can ask BHI to stop using all or some of your personal information (e.g., if BHI has no legal right to keep using it). You can ask BHI for a copy of your personal information. DATA RETENTION

BHI retains your personal information while your account is in existence or as needed to provide you the Service. This includes data you provided to us and data generated or inferred from your use of the Service. In some cases, BHI may choose to retain certain information in a depersonalized or aggregated form. If your use of the Service terminates for any reason, BHI will retain your personal data even after termination if reasonably necessary to comply with BHI's legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, or enforce our Terms of Service.
